Why didn't Manhattan District Attorney Cyrus Vance attend Police Commissioner Ray Kelly's momentous news conference last Thursday on the Etan Katz case?

Kelly announced that a suspect the public had never heard of -- Pedro Hernandez, a worker in a bodega near where 6-year-old Etan disappeared -- had been arrested after confessing to Etan's 1979 murder, and implied the case was solved.

Sources say Kelly had expressly invited [some say strong-armed] Vance to the news conference while excluding the FBI, which had worked with the NYPD for decades on the Patz case.

While at his news conference Kelly indicated that Hernandez's admission had ended the 33-year-old hunt for Etan's killer, Bureau officials remain skeptical, the sources said.

The FBI had expressed similar doubts about Kelly's trumpeted arrests in two recent terrorism cases involving so-called "lone wolves," distancing itself from both.

In each case, the so-called lone wolves -- Ahmed Ferhani and Mohamed Mamdouh in the first case, and Jose Pimentel in the second -- were indicted by Vance in state court because the FBI did not consider any of the suspects to be serious terrorism threats.

At each news conference, announcing their arrests, it was Vance, not the FBI., who stood at Kelly's side.

By choosing not to appear with Kelly at last week's news conference, Vance, too, appeared to express doubts.

His absence was all the more noticeable, considering the last line of Kelly's press statement, announcing Hernandez's arrest and confession: "We are working very closely with the Manhattan district attorney."

A top city law enforcement official said that Vance's reluctance to attend Thursday's news conference may also be related his re-election in 18 months and his attempt to avoid a repeat of another headline-grabbing case in which he followed the NYPD's lead -- his premature arrest last year of Dominque Strauss-Kahn.

Shortly after the NYPD pulled DSK off a Paris-bound plane, following his encounter with a maid in the Sofitel Hotel, Vance charged him with sexual abuse and attempted rape -- only to drop the charges because of subsequent doubts about the maid's credibility.

Instead, without Vance, Kelly had S. Andrew Schaffer, the NYPD's deputy commissioner of Legal Matters at the news conference, apparently to give Hernandez's arrest a legal imprimatur.

Schaffer was a silent prop. As with all Kelly news conferences, only the commissioner spoke for the department.

Sources also say that Vance is seeking to ensure that the FBI remains involved in the case.
Just a month ago, the Bureau dug up a Soho basement near where Etan disappeared, but failed to find evidence implicating another suspect.

After Hernandez's arrest, FBI agents attended case meetings at Vance's office along with the NYPD, sources say.

"The impression I am getting is that Vance wants the FBI involved even if it's only to raise his comfort zone with the investigative steps that remain before going to a grand jury," the source said.

Furthermore, sources say that neither the DA's office nor the FBI helped interrogate Hernandez in Camden, New Jersey. The interrogation, which led to a confession, was an exclusive NYPD affair.

The problem with Hernandez's confession and arrest, say law enforcement officials, is not that the police arrested him prematurely. As NYPD spokesman Paul Browne pointed out, once Hernandez confessed, detectives had no other choice than to arrest him.

Rather, the problem is Kelly's never-ending penchant for publicity and self-promotion [to say nothing of diverting people from his much-criticized Stop and Frisk and Muslim spying policies].

For in the Patz case, Hernandez's arrest is not the final step but only the beginning.
Hernandez's history of mental illness means that his confession, by itself, is not enough to indict, much less to convict.

"I have a bad feeling," said retired NYPD Lieu. Commander Vernon Geberth, the author of a definitive textbook on homicide.

"You need more than a confession. You need a body. You need forensic evidence. And there is none."

Kelly's statement at his news conference implied otherwise. Referring to Hernandez's confession and arrest Kelly said, "We can only hope that these developments bring some measure of peace to the family."

WHAT THE POST KNOWS. According to the New York Post, the NYPD has secret information never made public that only the killer knows. And 30 years ago, Hernandez told this to detectives, who blew him off.

This is startling.

"Pedro Hernandez provided detectives with 'intimate details' about the murder of Etan Patz that only the killer could have known," the Post reported.

Sources told the Post that "investigators were stunned to learn that Hernandez had this inside information, which cops never disclosed to the public despite intense public scrutiny and three decades of frustration in trying to unravel what happened to the 6-year-old in 1979."

"The specifics have remained secret and are known by fewer than a dozen current law-enforcement officials, including Police Commissioner Ray Kelly and Manhattan District Attorney Cy Vance, the sources said." [Question: if this inside information was so great, why wasn't Vance at the news conference?]

Then, the Post said this: "Meanwhile Kelly was said to be furious with the way the investigation into Hernandez was initially handled."

"He's upset and wants to know... Kelly is pissed. The heat is on."

Given the Post's reputation for, shall we say, exuberance, let's see how this all holds up.

THE LONDON CONNECTION. So there was Kelly in London, announcing Hernandez' arrest before barreling back to New York to hold his news conference.

How long was he in London? Nobody knows as Kelly refuses to make public his schedule, citing "security" concerns.

Two English newspapers reported last week that Kelly had been in London, advising authorities about security for the upcoming Olympics. Did they invite him? Or was he there on his own? More interestingly: who paid for his trip?

MORE MIKE. A day after the announcement of Hernandez's arrest, the Daily News' Mike Lupica was already slobbering over Kelly, this time writing that as a young cop, Kelly, apparently off-duty, had visited the block where Etan disappeared:

He was working vice in those days, back in 1979, in what they called the 'Public Morals Division' at the NYPD. He was back from Vietnam and he was a young cop with two young children -- ages 11 and 13. So he was both a parent in the city and a policeman when Etan Patz disappeared on his way to school.

Let's see. That visit would be a couple of years after Kelly walked a beat in Harlem and supposedly befriended a young Al Sharpton, who was then attending school in Brooklyn. Apparently, the future Rev was playing a lot of hooky those days, hanging around Harlem enough to become pals with Kelly.

Let's hope that Lupica's description of Kelly has more credibility than that Paul Browne-spun fairytale.

SHOT CLOCK STILL TICKING. With all the brouhaha over the Patz case, let's not forget Kelly's ticking time bomb, which so far he has successfully defused.

That's his commission to examine whether the downgrading of crime statistics is a city-wide problem.

Kelly formed the commission after police broke into the apartment of whistle-blower cop Adrian Schoolcraft, then took him against his will to the psych ward of Jamaica Hospital after Schoolcraft claimed that commanders in his Brooklyn precinct were systemically downgrading crimes. Spokesman Browne estimated at the time that the commission's report would be completed within six months. It's now more than two years. One of the three commissioners has already died.

For the record, the report is 697 days late.

Often we tend to believe that what we need to turn our dreams into reality are things we do not have. It is common to hear; "Oh if only I had this, I will do that." God wants us to start with what we have and not what we do not have. So cut off the "If" and start with what you have. What we have is almost not enough. What we have may not be enough, but it will always contain the potential for what we want.

We should not always see things the way they are, but the way they could be. Those who believe and talk lack hardly ever have enough. God has created more wealth in this world than we would ever need. You may ask; where is it? It is in potential form. When you believe it is there and search for it, you will find it.

You will release your potential for financial success when you recognize the potential in the people and things God has positioned around you. It will enable you to see solutions where others see problems. Where a loser sees a problem the winner sees an opportunities. The principle of financial increase obey the law of sowing and reaping. The harvest you want will always be inside the seed you have.

This is my grandfather, Larry and my Grandmother, Bettina, aka La Jolie Grandmere.

This picture was taken in the mid 1960s just after they married and built their home in the South of France.

Larry always looked at my grandmother as if she was the only one in the entire world...

They shared a love, respect and admiration most only dream...

He served our country. He piloted jet planes in the Second World War.?

He lived long enough to have an amazing career as a novelist and Hollywood producer for MGM Studios.

He lived long enough to meet and marry my grandmother later in life.

He was an amazing, adoring and doting husband, step-father and grandfather...

Among a myriad of accomplishments he was an avid tennis player. He played well until his 90s. He was 10 years older than my grandmother. She passed away nearly 10 years ago from a form of Leukemia.?

He passed away a few months later... from, I am quite certain, a broken heart.
But his life was long and rich and full...?

We must take a moment to thank all of those who have served our country and who are serving our country and to celebrate those who are no longer with us...

And especially those who never got to follow their dreams...

Who never met true loves... Who passed away much too young...

While we remember them, let's celebrate life and soak it all up!

I hope you all have a wonderful Memorial Day filled with family, fun and?barbecues.

Campbell River Mayor keeps up war of words on staff

Mayor Walter Jakeway says city hall is wasting taxpayers? money.

Jakeway, the keynote speaker at the noon hour Rotary Club?s weekly luncheon, had some tough words for senior city staff.

?City hall is an example of how they?re doing it in the least effective way,? Jakeway told Rotarians gathered at the Discovery Inn Wednesday afternoon. ?City staff say how hard they?re working; do I care how hard they?re working? No, I don?t, if the results aren?t there.

?Wasting hard-earned taxpayers? money is not acceptable to me,? Jakeway continued. ?I didn?t run to leave things how they are, I ran to shake it up.?

Jakeway, who was elected mayor last November, ran his election campaign on a zero per cent tax increase platform. After council chose last month to increase residential property taxes by 13.6 per cent, Jakeway advocated for a public tax revolt.

He maintains the tax increase could have been avoided had council chose to cut city staff.

Jakeway says he spoke to Mayor Dan Ashton of Penticton, a community similar in size to Campbell River, about staffing levels while at the inaugural B.C. Mayors? Caucus last week.

?Penticton in the last two years has shed 31 people,? Jakeway said. ?Penticton started at the top and worked their way down.

?Campbell River must do the same. It?s currently bogged down by the same old habits.?

Jakeway said things will never change at city hall if the same senior city managers remain at the helm.

?The 2012 Campbell River city budget process was a manipulative game, but that was to be expected,? Jakeway said. ?The theme was to preserve the bureaucracy at all costs and to spend, spend, spend.

?Change does not come easy. With my business training I really did not expect a zero per cent tax increase but I know it was achievable.

?We can?t do it with these same people (at city hall).?

During budget deliberations, some councillors championed trusting city staff to build a budget, but Jakeway questioned that tactic.

He said staff played ?a game of divide and conquer and council fell for it?, referring to council?s 4-3 split in a vote which led to adoption of the budget.

Jakeway also accused city staff of biased public relations.

?The senior staff don?t get it, they really don?t,? he said. ?They don?t have the skill set, they cling to their policy documents.?

Jakeway acknowledged his words might rub some people the wrong way, but he kept going.

?I?m fully aware people on council and senior staff will not be happy with my comments,? he said. ?But have you ever been to city hall? How did you feel when you visited? The atmosphere is toxic, there has to be a change and it won?t necessarily be pretty. Things have to change come hell or high water.?

Jakeway then proceeded to list several expensive city projects that have had their share of controversy.

He noted the three-year anniversary of the Dogwood Street lights is quickly approaching and motorists still complain about the three-cycle system.

?How about the toilets from hell by the Art Gallery ... $90,000 for two toilets, an outdoor lacrosse for (more than $300,000); a $13.5 million Highway 19A upgrade and the lanes are too narrow and Spirit Square at roughly $1.7 million,? Jakeway said. ?I deal in facts, not emotions. I?m not unhappy or angry ... I know the system malfunctions.?

Jakeway said his dream would be to have a ?nimble? team to lead the city and boldly promote Campbell River to the world.

He would also like to change how taxpayers pay their property taxes to allow them to pay in monthly instalments.

The mayor also plans to improve the Campbellton area and tackle homelessness.

Jakeway said if Campbell Riverites work together the city can improve and the economy will rebound.

Nothing breeds copycats like a successful business venture. When a new business idea is incubated and executed successfully, cloners naturally emerge and imitate. To mitigate the investing risks associated with eroding market opportunities due to copycats, investors always look for companies with strong competitive resilience or those that are operating in markets with a high barrier to entry. In traditional investing philosophy, the most innovative firms are potentially the most profitable. So, from business books to business schools and corporate boards, everyone is talking about innovation. But, copying others is a reality of doing business. In African open markets, women will switch from selling bananas to selling yams once they notice that their neighbors are making more profits from yams. Even in developed markets like Western Europe and the U.S., companies copy ? though with enough sophistication to avoid legal problems. Despite all the branding differences, Apple iCloud, Microsoft SkyDrive, Google Cloud Storage, and Dropbox are imitating one another. And who can argue that smartphone manufacturers aren't copying each other?

Yet, the focus on entrepreneurship training and startup intervention programs has centered on innovation. Few people ask entrepreneurs to go out there and copy others. While innovation funds are common, it's rare to read of imitation funds. Innovation has become a buzzword that connotes respect and profitability. It is seen as the fulcrum that will propel a business to success. So, firms are encouraged to invest in R&D to outflank competitors with potentially better products that could win markets and generate better margins. The push to the top of the innovation index means that some companies will try to avoid what others have done ? even when others are yielding better results.

Personally, that has always been my way of looking at business ? innovate or perish. And I have also supported the notion that innovation is central to economic prosperity. But I experienced a different perspective in Abuja, Nigeria, two months ago when I visited to keynote a tech conference. A venture capitalist there was essentially running an imitation fund. He invited me to help evaluate potential ideas for investment. Naturally, I was looking for something new, not just in the African context, but globally. I made my recommendations, but the investor rejected all of them. He ranked my selections low and explained that he was out to make money and was therefore looking for companies that could copy successful global companies and tailor them for West African markets. It was immaterial whether the ideas were copied or not, provided that the process was lawful. He explained that Nigeria should not be pushing for innovative startups, but should instead be looking for ways to incubate copycat companies. He called it the Chinese method and said that Africa should follow it because it works.

I can understand companies copying ideas and adapting them for specific markets. But the story of these three German bothers, Marc, Alexander and Oliver Samwer, who've made their fortune building copycat companies, challenges that thinking. These brothers are among Europe's most consistently-successful internet entrepreneurs. They are rich and the company is estimated to be worth at least a billion dollars. They have copied top web companies from Pinterest to Groupon and eBay to Airbnb, and have invested in Facebook, LinkedIn and Zynga. Rocket Internet, their incubator, is a dominant force in Europe. They believe that, if you cannot create new ideas, you can legally copy them, as Oliver said in a recent interview: "Just as we might have a very good gift of execution, others have a unique gift for the purest form of innovation." But, most times, the only difference they bring to the table is the name of the product ? the color, the text, the photos ? and everything else remains the same.

Imitating others may not offer the best path to becoming an industry leader. And it's not without risk. For instance, pioneers can command strong market loyalty that could be difficult for copycats to overcome. Still, startups need to understand that even big companies copy. Would Apple have created the iPhone if there was no BlackBerry? Entrepreneurs need to think about whether they need to innovate when there are business models that can be copied lawfully. The Samwer brothers have certainly shown that in the absence of innovation, copying and funding already-tested business models can work.

NFL union files suit against league over 2010 cap

The players union claimed Wednesday that the NFL imposed a secret salary cap during the uncapped 2010 season that cost the players at least $1 billion.

The complaint was filed in U.S. District Court in Minneapolis, which oversees the Reggie White settlement covering NFL labor matters. But the league says the union has no grounds for the action and is prohibited from filing it by the collective bargaining agreement.

The complaint claims a "conspiracy" to set a $123 million salary cap for the 2010 season, when owners did not have the authority to do so. The Cowboys and Redskins have had their future salary caps lowered for overspending in 2010, Dallas by $10 million over two seasons, Washington by a whopping $36 million.

Both teams lost a grievance against those reductions on Tuesday.

"When the rules are broken in a way that hurts the game, we have an obligation to act. We cannot stand by when we now know that the owners conspired to collude," union chief DeMaurice Smith said Wednesday.

In response to the reopening of the Reggie White lawsuit, NFL spokesman Greg Aiello said, "There was no collusion. There was no agreement. These claims are totally unfounded."

A league statement said the collective bargaining agreement signed last August to end the 4?-month lockout prohibited the filing of these claims, and that players' attorneys signed a separate agreement agreeing to the terms.

But NFLPA outside counsel Jeffrey Kessler said that agreement was rejected by the court.

"The document they are referring to was not accepted by the district court in Minnesota," he said Wednesday. "It was rejected and the court entered an order which only dismissed claims under White that were pending."

The NFL also points to a clause in the latest labor contract in which the union gives up the right to sue over "collusion with respect to any League Year prior to 2011."

Thus, the NFL has considered the 2010 uncapped season a closed matter ever since the new labor deal was signed last summer. Clearly, the players do not, and now are seeking compensation for lost wages caused by collusion among the teams.

"Our union recently learned that there was a secret salary cap agreement in an uncapped year," NFL Players Association President Domonique Foxworth said. "The complaint today is our effort to fulfill our duty to every NFL player. They deserve to know, above all, the facts and the truth about this conspiracy."

The 2006 CBA included an uncapped 2010 season as the final year of the deal. It was thought that neither the league nor the union would want the potential chaos of a season with no salary cap, but that proved false as negotiations on a new contract stagnated.

Just over two months after that uncapped season, the league locked out the players in March 2011. The salary cap was reinstated in the new, 10-year CBA finalized last August.

But on March 12, just before free agency began, the Redskins and Cowboys had their salary caps reduced over the next two seasons. The NFLPA was involved in that process, with 28 other clubs getting a boost in their salary caps for 2012 and '13.

Oakland and New Orleans do not share in the redistributed salary cap space because they engaged in similar practices, but not to the degree of Washington and Dallas.

The union now believes Dallas and Washington were punished for exceeding a covert salary cap in 2010, not for undermining competitive balance, as the NFL has claimed.

"The league expressed their view that they thought those teams had gotten a competitive advantage," Kessler said. "If we wanted other salary cap increases for the clubs (in 2012) ... the price for doing that was doing this salary cap reallocation.

"Had the union known about prior collusion, the union would never have agreed to these cap reallocations."

The union says the league office approved contracts enabling the Redskins, Cowboys, Raiders, and Saints to exceed that "secret, collusive salary cap."

This is dangerous territory for any sport.

In baseball, the union filed collusion grievances following the 1985, 1986 and 1987 seasons accusing management of conspiring against free agents. After arbitrators ruled in the union's favor, management agreed to a $280 million settlement. Among the players affected were Jack Morris, Andre Dawson, Tim Raines, Jack Clark and Lance Parrish.

A triple-damages provision was inserted into the sport's labor contract in 1990.

New frog species from Panama dyes fingers yellow

A new bright yellow frog species has been found in the mountains of western Panama. The frog belongs to a species-rich group of frogs, the so called rainfrogs that lack a tadpole stage, but develop directly as little frogs inside the egg.

The frog, that measures less than 2 cm, was discovered by Andreas Hertz and his colleagues, who are reptile and amphibian specialists at the Senckenberg Research Institute in Frankfurt am Main; Germany. They discovered it in 2010 during several field trips to the Serran?a de Tabasar? of western Panama a highly understudied part of the Panamanian central mountain range.

"Although we recognized that the male mating call of this species differs from all what we had heard before and therefore suspected it to be new, much effort was involved to finally spot it in the dense vegetation", said Hertz. "When we finally caught the first individuals by hand, we noticed that it dyes one's fingers yellow when it is handled. The scientific name (Diasporus citrinobapheus) of this new frog refers to this characteristic and means yellow dyer rainfrog."

To assure the validity of the frog as a new species, the biologists studied body structure, coloration, molecular genetic data, and vocalizations of a series of individuals, and compared the results with the data derived from closely related species.

Additionally, the researchers took into consideration the possibility that the yellow stain may be poisonous and performed an analysis of skin secretions. "We cannot say whether the dye is any good as a predatory defence, as we could not find any poisonous components. Maybe the colour is just easily washed out and has no particular function. However, for now, this peculiarity of the new species remains enigmatic." said Hertz.

You?ve apparently become more aware of affirmations because the movie The Secret became a hit. Affirmations are express statements said in the present tense to convey about powerful changes in a person?s life. Affirmations can be around changes you wish to see on a physical level; like as weight, how you wish to live your life; like as diet and exercise, or vacations, financial success; such as how much you wish to earn on an yearly basis, or how many rental properties you?d like to own. More people have affirmations of a spiritual world, others are about motivation.

Over the years I hold seen some people make vast changes in their lives once starting to use affirmations. Through others, I?ve seen them give up on their dreams as unfortunately their affirmations harbor?t come to fruition. So why would affirmations act for some and not others?

Gary Craig and Donna Eden interpret how this can be so in the book The Promise of Energy Psychology; they direct to them as tailenders. What they are referring to are affirmations that are settled and then quickly followed by that small voice inside of you that denies that the affirmations could at any time come true. An example of this is a mistress called Susan who has an affirmation that says ?I luckily weigh 60 kg?. This is speedily followed by her inner voice saying ?Don?t be ludicrous Susan you?ll never lose that abundant weight, after all, your mother is fat and so are your siblings. In other language the belief that Susan is holding in her subconscious is that she power of determination always remain fat because its heredity.

So how do we vary the belief? By using EFT Tapping to tap on the ?tailender.? A fit tapping phrase for the above example could be;

If you are not having issue with some of your affirmations examine the possibilities of what your subconscious believing around it could be. Say the affirmation out loud and at that time listen to anything your inner spoken sound says afterwards. That will be your ball of thread. Then tap the old belief away and step back and wait for the results!
